Beta Test Agreement for Blackridge Investments LLC
This Beta Test Agreement (this "Agreement") governs your access to and use of any Normality product, build, feature, loader state, or service offering that is identified as "Testing" on the public status page, a product page, the dashboard, the loader, or any other Company-controlled communication. Normality is a brand operated by Blackridge Investments LLC (the "Company", "us", "our", and "we").
If a product is marked "Testing", it is a beta release. It may be unstable, incomplete, substantially modified, or withdrawn entirely. By accessing, downloading, activating, or using any product marked "Testing", you agree that you do so entirely at your own risk.
You accept that any damage, loss, instability, detection, account action, system issue, or other negative result arising from a Testing product is your responsibility and not the Company's responsibility.
1. Beta Access and Limited License
Subject to the terms and conditions of this Agreement and our Terms of Service, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use a Testing product solely for your own evaluation and testing during the period designated by the Company. This access may be restricted, suspended, or revoked at any time in the Company's sole discretion.
2. Products Covered by This Agreement
This Agreement applies whenever the Company marks a product or release as "Testing". That includes situations where the public status page, store page, launcher, dashboard, or another Company-controlled interface shows the Testing label or otherwise communicates that a release is a beta, unstable, or pre-release build.
A Testing product is not considered a final, production-ready, or commercially stable release. A product may remain in Testing for any length of time, may return to Testing after being stable, or may never be released in final form.
3. Confidentiality and Non-Public Information
You agree to hold in strict confidence and not disclose to any third party any non-public information made available to you in connection with a Testing product except as expressly approved in writing by the Company. This includes non-public software, builds, features, changes, research, development details, technical processes, documentation, screenshots, account access details, and other information that is not publicly released by the Company.
Your confidentiality obligations do not apply to information that you can document: (a) was public at the time it was disclosed to you; (b) became public through no fault of yours; (c) was already lawfully in your possession without confidentiality restrictions; (d) was lawfully disclosed to you by a third party without confidentiality restrictions; or (e) was independently developed without access to the Company's confidential information.
4. Restrictions
You may not use a Testing product or related confidential information to:
- reverse engineer, decompile, disassemble, crack, modify, or derive source code from the product;
- redistribute, resell, sublicense, share, or transfer access to the product or any related material;
- create competing or derivative products based on the Testing product or confidential information; or
- publish, leak, or disclose non-public details unless the Company has expressly authorized such disclosure in writing.
5. Acknowledgement of Beta Risk
You acknowledge and agree that a Testing product is a beta release and is not at the level of performance, stability, safety, or reliability of a commercially available final release. A Testing product may fail to operate correctly, may contain bugs, may crash, may behave unpredictably, may be substantially modified before release, or may never be released commercially at all.
You further acknowledge that use of a Testing product may result in, without limitation:
- software errors, instability, loader failures, or incomplete functionality;
- system crashes, degraded performance, corrupted settings, corrupted files, or data loss;
- game bans, account suspensions, HWID actions, platform restrictions, platform security detections, or related enforcement actions by third parties;
- loss of access to purchased products, temporary unavailability, or interruption of service; and
- other direct or indirect losses affecting your device, software environment, accounts, or use of third-party services.
6. No Warranty
TESTING PRODUCTS AND RELATED DOCUMENTATION ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by law, the Company and its licensors disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, quiet enjoyment, and performance.
No oral or written advice or information given by the Company, its employees, agents, moderators, administrators, or support channels will create any warranty regarding a Testing product.
7. Assumption of Risk and Release of Liability
THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF A TESTING PRODUCT REMAINS WITH YOU. By using a Testing product, you accept full responsibility for your decision to use it and for any outcome that results from that use.
THE COMPANY AND ITS LICENSORS SHALL NOT BE LIABLE FOR ANY LOSS OF USE, LOST PROFIT, LOST DATA, SYSTEM DAMAGE, DEVICE DAMAGE, ACCOUNT ACTION, GAME BAN, HWID ACTION, BUSINESS INTERRUPTION, COST OF COVER, OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO A TESTING PRODUCT OR THIS AGREEMENT, HOWEVER CAUSED AND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IF A PRODUCT IS MARKED "TESTING", ANY DAMAGE OR LOSS ARISING FROM ITS USE IS NOT THE COMPANY'S RESPONSIBILITY. This includes, without limitation, damage to hardware, software, files, configurations, game accounts, platform accounts, licenses, or access to third-party services.
To the maximum extent permitted by law, the Company's aggregate cumulative liability for claims arising out of or related to this Agreement or a Testing product will not exceed USD $50.00 or the amount actually paid by you for the applicable product, whichever is lower.
8. Feedback
If you provide feedback, bug reports, suggestions, or other comments regarding a Testing product, you grant the Company the unrestricted right to use and exploit that feedback without compensation, attribution, or obligation to you. The Company may use such feedback for any purpose, including product development, testing, security, and commercial release planning.
9. Termination and Return of Materials
The Company may terminate your access to a Testing product at any time, with or without notice. Upon request by the Company, or when your evaluation period ends, you will stop using the Testing product and destroy or delete any non-public software, files, documents, notes, screenshots, or materials made available to you in connection with that Testing product, except where retention is required by law.
10. Relationship to Other Policies
This Agreement supplements the Company's Terms of Service, Software Licensing Agreement, Privacy Policy, and Refund Policy. If a Testing product is involved, this Agreement controls to the extent it imposes additional risk disclosures, disclaimers, confidentiality obligations, or beta-specific restrictions.
